‎Oluyole APC Primary: Gbolagade Drags APC, INEC, Sadipe Akande To Court, Secures Substituted Service Order

Hon. Abiodun Gbolagade, an aspirant of the All Progressives Congress (APC) for the Oluyole Federal Constituency, has instituted a suit before the Federal High Court in Ibadan challenging the process that produced the party’s candidate for the constituency in the forthcoming general election.

The suit lists the Independent National Electoral Commission (INEC), the APC, and the lawmaker representing Oluyole Federal Constituency, Hon. Tolulope Sadipe Akande, as the 1st, 2nd, and 3rd respondents, respectively.


‎At the first sitting of the matter before Court 1 of the Federal High Court, Adeoyo, Ibadan, on Tuesday, the court granted the plaintiff leave to serve the 3rd respondent through substituted means after attempts to effect personal service were unsuccessful.

‎Counsel to the plaintiff informed the court that while the originating processes had been successfully served on INEC and the APC, repeated efforts to personally serve Hon. Sadipe Akande did not yield results.

The plaintiff’s legal team subsequently moved an ex parte application, dated and filed on July 15, 2026, seeking an order of court permitting substituted service on the 3rd respondent.

After considering the application, the court granted the request.

‎In the substantive suit, Gbolagade is asking the court to determine the validity of the process that produced Hon. Sadipe Akande as the APC’s consensus candidate for the Oluyole Federal Constituency.

The plaintiff maintains that the outcome of the party’s primary election was in his favour and is seeking judicial determination over the emergence of the 3rd respondent as the party’s candidate.

None of the respondents was present in court or represented by counsel during Tuesday’s proceedings.

The court subsequently adjourned the case to September 15, 2026, for definite hearing of the substantive suit.
